Object of the Contract

The offer and sale of products on our website www.PiattiProntiChef.it (hereinafter the site) are governed by these General Conditions of Sale.
The products purchased on www.PiattiProntiChef.it are sold directly by Eurochef Italia SpA ("the Seller").
Eurocchef Italia Srl is registered in the Verona Companies Register no. REA 289800, and VAT number 02857130237. The registered office of Eurochef Italia SpA is in Italy, in Via della Tecnica, 40, 37066 – Sommacampagna (VR)
The Seller offers for sale and the buyer purchases with a remote sales contract, via the Internet, the Products selected and ordered by the Buyer from those included in the electronic catalogue and currently available.
The service is currently active for purchases to be delivered exclusively in Italy. All sales, delivery and payment methods are listed in detail in the various "Help" sections of the Site and are to be considered an integral and substantial part of this contract. The conditions applicable to each individual order will be those set out on the Site at the time of the order itself. Any new conditions will be effective from the moment of publication on the Site and will apply only to sales concluded subsequently.

Conclusion of the Contract

The contract is considered concluded, and is binding for both parties, when the seller receives confirmation of payment of the entire purchase order.PiattiProntiChef.it reserves the right not to accept incomplete and/or incorrectly filled out purchase orders.

Buyer's obligations

  1. The buyer undertakes, once the online purchase procedure has been completed, to print and/or keep these general conditions, as well as to print the specifications of the product being purchased, in order to fully satisfy the condition set out in articles 52 and 53 of Legislative Decree 206/05.
  2. The buyer is strictly prohibited from entering false and/or invented and/or imaginary data in the registration procedure necessary to activate the process for the execution of this sales agreement and the related further communications; the personal data and e-mail must be exclusively the real personal data and not those of third parties.
  3. The buyer declares to be of legal age.

Shipping times and methods

The Seller assumes the responsibility of delivering to the buyer, at the place indicated by the latter, by courier or its own means, the products selected and ordered by the latter.
In the event of failure to ship the products by the Seller, the buyer is entitled exclusively to a full refund of the sums paid. To find out the specific methods of shipping and delivery of the products, access the section Fast Delivery ». Please pay attention to what is reported in this section because the information contained therein forms an integral and substantial part of these General Conditions of Sale and, therefore, are considered to be fully known and accepted by the Customer at the time of transmission of the order form.

Payment and billing methods

The purchase can be paid by the Customer at his/her choice with the methods indicated on the site in the How to Purchase » section. The payment will include the costs for the shipping contribution.
For each order placed on the PiattiProntiChef.it website, Eurochef Italia issues an invoice for the material shipped. The invoice is issued at the same time as the order is processed and normally accompanies the goods in the envelope placed on the packaging or inside the package.
For the issuance of the tax document, the information provided by the buyer at the time of ordering or subsequently will be valid. No changes will be possible after the issuance of the tax document.
The amounts will be reported in the invoice in Euro. The buyer undertakes to carefully check the data entered at the time of the order, because these will be used for accounting records.

Orders and prices

The order for each individual supply is considered accepted when confirmation of payment is received, without prejudice to the Seller's unquestionable right not to accept orders received.
All prices shown in the shop windows, on the product sheets and during the purchasing procedure are indicated in Euros and are subject to change, therefore they can be updated and subject to changes on a daily basis.

Product images and descriptions

Product images are purely indicative and may therefore not be perfectly representative of the product characteristics and do not constitute a contractual element.
The ingredients and percentages indicated in the descriptions are purely indicative, they may be subject to variations based on different production needs.

Contribution to shipping costs

Shipping costs will be borne by the Customer and are clearly displayed before completing the order.
For purchase orders, the buyer will pay the Seller, as a contribution to shipping costs, the amount indicated in the cart when placing the order.

Nature and availability of products

The products for sale are those described in the electronic catalogue of the site where the name of the product and any description specify the main characteristics of the products. The graphic design of the products delivered may not coincide exactly in shape or colour with that represented on the Site.
The products on sale are produced daily based on orders, in exceptional circumstances, raw materials for production may be lacking (excess demand or other causes), therefore, we would be unable to deliver the complete order. The Seller will not be in any way responsible for the temporary or permanent unavailability of one or more products. In the event of unavailability, even temporary, of the requested products, the seller undertakes to promptly inform the Customer by proposing an alternative product or by reducing the amount of the unavailable product, on the next order.

Limitations of liability

The Company undertakes to implement the rules relating to the cold chain and in general the quality standards relating to the Products exclusively up to the time of delivery to the place indicated by the Customer; any liability relating to the poor condition of the Products due to improper storage after the time of delivery or at other delivery points authorised by the Customer is excluded.

For everything that does not concern the products on sale on its online shop, the Company declines all responsibility for the information, data and any technical or other inaccuracies that may be contained on the Website.

The Company declines all responsibility for the information provided/acquired directly from the individual Producers.

Any disputes relating to the execution of the Service may be raised within 48 (forty-eight) hours of delivery by writing to info@eurochefitalia.com or through the “Contact Us” section, documenting the dispute also with photographic material.

The Company shall not be liable for any damages resulting from the inaccessibility to the Services resulting from problems connected to the network, providers or telephone and/or telematic connections over which it has no control, or from the failure and/or defective functioning of the electronic equipment of the User or of the Company's suppliers.

The Company assumes no responsibility for content created or published on third-party sites to which the Website has a hyperlink (“link”). The User who decides to visit a website linked to the Website does so at his/her own risk, assuming the burden of taking all necessary measures against viruses or other malware.

The Registered User acknowledges and accepts that occasionally not all the Products indicated in the order sent and accepted by the Company may be delivered. In this case, the Company will promptly refund the amounts relating to the Products ordered and not delivered and cannot be held responsible for any further loss and/or damage suffered due to the failed delivery.

For each order placed, Eurochef Italia will issue a specific receipt or electronic invoice in the event of an explicit request by the User. The data provided by the Registered User at the time of the order will be included in the relevant receipt/invoice, without prejudice to the fact that no changes will be possible following the issuance of the receipt/invoice itself.

Information on the legal guarantee of conformity

Legal Guarantee of Conformity
All products sold on the site “www.piattiprontichef.it” (“Site”) are covered by the legal guarantee of conformity provided for by articles 128-135 of the Consumer Code (“Legal Guarantee”).

To whom does the Legal Guarantee apply?
The Legal Guarantee is reserved for consumers (see art. 3, paragraph 1, letter a) of Legislative Decree 6 September 2005, n. 206 - “ Consumer Code ”). Therefore, it applies only to users who have made the purchase on the Site for purposes unrelated to any entrepreneurial, commercial, artisanal or professional activity they may carry out. Those who have purchased on the Site and who do not have the status of consumers will be subject to the guarantees for defects in the item sold, the guarantee for lack of promised and essential quality and the other guarantees provided for by the civil code with the related terms, forfeitures and limitations.

When the Legal Guarantee applies The seller, Eurochef Italia SpA , therefore, with regard to purchases made on the Site, is responsible towards the consumer for any lack of conformity existing at the time of delivery of the product and which becomes apparent within two years of such delivery. The lack of conformity must be reported to the seller, under penalty of forfeiture of the guarantee, within two months of the date on which it was discovered.

Unless proven otherwise, it is presumed that any lack of conformity which becomes apparent within six months of delivery of the product already existed on that date, unless this assumption is incompatible with the nature of the product or the nature of the lack of conformity.

In order to benefit from the Legal Guarantee, the user must first provide proof of the date of purchase and delivery of the goods. It is therefore advisable for the user, for the purposes of such proof, to keep the order confirmation email or the receipt or, as the case may be, the commercial invoice and the List of Withdrawn Products that are delivered to him at the time of collection or delivery or any other document that can certify the date of purchase (for example the credit card statement or the bank statement) and delivery.

What is a lack of conformity?
There is a lack of conformity when the purchased good:

1. is not suitable for the use for which goods of the same type are normally used;

2. does not conform to the description given by the seller and does not possess the qualities of the good that the seller presented to the consumer as a sample or model;

3. does not have the usual qualities and performances of a good of the same type, which the consumer can reasonably expect, also taking into account the declarations made in advertising or on labelling;

4. is not suitable for the particular use intended by the consumer and which was brought to the attention of the seller by the latter at the time of conclusion of the contract and which the seller accepted.

Therefore, any faults or malfunctions caused by accidental events or by the user's responsibility or by use of the product that does not comply with its intended use and/or with what is provided for in the technical documentation attached to the product are excluded from the scope of the Legal Guarantee.

Remedies available to the user
In the event of a lack of conformity duly reported within the terms, the user has the right:

  • primarily, to the free repair or replacement of the goods, at his choice, unless the requested remedy is objectively impossible or excessively onerous compared to the other;
  • secondarily (i.e. in the case in which the repair or replacement is impossible or excessively onerous or the repair or replacement has not been carried out within an appropriate time frame or the repair or replacement previously carried out has caused significant inconvenience to the consumer) to the reduction of the price or to the termination of the contract, at his choice.

The remedy sought is excessively burdensome if it imposes unreasonable costs on the seller in comparison with alternative remedies that can be pursued, taking into account: (i) the value that the good would have if there were no lack of conformity; (ii) the extent of the lack of conformity; (iii) the possibility that the alternative remedy can be pursued without significant inconvenience for the consumer.

What to do in the event of a lack of conformity
In the event that a product purchased on the Site, during the period of validity of the Legal Guarantee, shows what could be a lack of conformity, the user can contact the Customer Service of Eurochef Italia SpA, at the contact details indicated in the "Contacts" section of the Site. Prompt feedback will be given to the reporting of the alleged lack of conformity and the specific procedure to follow will be indicated to the user, also taking into account the product category to which the product belongs and/or the reported defect.

Eurochef Italia SpA reserves the right to ask the user to attach to the request to use the Legal Guarantee, the order confirmation email or the receipt or, as the case may be, the commercial invoice, together or not with the List of Products Withdrawn, issued at the time of collection of the shopping or other document proving the date of purchase and the delivery date.

Right of withdrawal

Cases of exclusion of the right of withdrawal
Pursuant to art. 59, paragraph 1, letters d) and e) of Legislative Decree 6 September 2005, n. 206 (Consumer Code), the right of withdrawal is excluded in relation to:

  • Goods purchased by a non-consumer Customer and/or one who requests an invoice;
  • Goods which are liable to deteriorate or expire rapidly;
  • Sealed goods which are not suitable for return for hygiene or health protection reasons and which have been opened after delivery.

With reference to the cases of exclusion of the right of withdrawal listed above, the Customer, in particular, is informed and accepts that among the Products that "risk deteriorating or expiring rapidly" are included all food products, as the characteristics and qualities of these types of Products are subject to alteration also as a result of inappropriate storage. Therefore, for reasons of hygiene and protection of Users, the right of withdrawal is applicable only for Products purchased on the Website that can be returned to Eurochef Italia, intact in the respective seal, and put back on the market without danger to the health of consumers.

Exercising the right of withdrawal
The Customer may exercise the right of withdrawal, pursuant to art. 52 et seq. of Legislative Decree 206/2005, in relation to specific Products, other than those listed in the previous paragraph 11.1, provided that these, after delivery, have not been opened or their seals altered.

In cases where the right of withdrawal is permitted, the Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty.

To exercise the right of withdrawal, the Customer must send Eurochef Italia, within 14 days from the date of delivery of the Products, a written communication by email to the following email address info@eurochefitalia.com with the subject “Exercise of the right of withdrawal” and:

  • expressly declaring your wish to withdraw and providing the following additional information: purchase order number and date;
  • purchase order delivery date;
  • the name and address of the Customer;
  • the indication of an email and telephone contact of the Customer;
  • code of the item or items for which you intend to exercise the right of withdrawal.

The right of withdrawal applies to the Product purchased in its entirety; therefore, if the Product is composed of multiple components or parts, the right of withdrawal cannot be exercised on only part of the purchased Product.

Upon receipt of the communication of exercise of the right of withdrawal, Eurochef Italia will open a file for the management of the return and communicate to the User the instructions on how to return the Products, which will take place via a courier indicated by Eurochef Italia itself.

In case of exercising the right of withdrawal, Eurochef Italia will refund the User the entire amount of the returned Products, within 14 days from the date on which the withdrawal notice was received, without prejudice to the right of Eurochef Italia to suspend the payment of the refund until the actual receipt of the Products. The refund will be made using the same payment method used by the User.

Changes

The Seller reserves the right to change these General Conditions at any time by publishing the updated version on the website www.PiattiProntiChef.it. The new General Conditions of Sale will be effective from the date of publication on www.PiattiProntiChef.it

Applicable law and dispute resolution

This contract is governed by Italian law. These general conditions refer, for anything not expressly provided for therein, to the combined provisions of Legislative Decree 50/92 and Legislative Decree 206/05.

Competent court

Any and all disputes that may arise in relation to the application, interpretation of this contract stipulated online through the website www.PiattiProntiChef.it are subject to Italian jurisdiction in accordance with current legislation.
For any disputes arising between the Parties in relation to this contract, the competent court is the one of the place of residence or domicile of the purchaser if located within the territory of the State.
If the residence or domicile of the purchaser is not located in the territory of the State, the Court of Verona shall have jurisdiction.
